Telemarketing, Independent Contractor vs. Employee There was a man in the land of UZ, whose name was Job. The Book of Job, in the Old Testament is considered to be a "teaching" of how, to over come hard times. Since I was a teenager, I have always found a "job" to be a test. A test of commitment and endurance, whose benefits, included income. It is no coincidence that the story about Job, in the Old Testament (Bible), and the word "Job," actually, means an activity performed in exchanged for payment. Around, 1760, people begin to hear two very, different words, in reference to a job. These words were "Independent Contractor." In recent years, there has bee much written on the definition of an employee vs. an Independent contractor, and the IRS has had, the final say. On the IRS.gov web site, an Independent Contractor is described as such: An employer has the right to control or direct only the result of the work done by an independent contractor, and not the means and methods of accomplishing the result.. Misinterpretation of the correct status of a person working as an Independent Contractor, who is later deemed to be an employee, by the IRS, is costly, both to the Independent Contractor and the Employer. Back taxes for social security and medicare must be paid by both sides, and not without penalties. The major factors in determining if a person is an employee, or can be considered an Independent Contractor, is in the degree of control and independence of the worker. Paying a telemarketing or business development, person, by the hour and expecting that certain task are completed within that hour, could be considered an employee, employer relationship, even if the employee works from home. This is more true, when the employer determines "how" the work is to be completed, and what time of the day. When a company provides, guidance, leadership, options, and freedom of choice, on hours worked, time worked and method of completing the work, there is very little chance that the IRS will consider the business relationship to be that of an employee and an employer. Because of these tax laws, companies who offer work opportunities, must be extremely careful in how the job is structured. Our very small specialized department of, Invoice Lines of Credit, receives many request for hourly wage telemarketing positions. However, when you pay someone who is working from home, an hourly wage, there must be certain stipulations, such as $10 per hour, plus a bonus, with 20 calls per hour, and a detailed summary of all calls, to be emailed each day, this could be considered an employee, employer relationship. And when the employer provides the script and makes other demands, this leaves the door open for interpretation, from the IRS. Because the employer is not there to enforce their procedure and methods to complete the task, they are at a serious disadvantage. On the other hand, when you allow professional telemarketers, free will, using professional options, you are no longer the employer. You have entered into a business agreement. A relationship of equals, which results in compensation, commissions, being based on efforts. The pay paycheck goes up from $150 a week plus bonus, for 3 hours a day, 5 days per week, to $2000 to $6000 a month, working very few hours. This brings about, a whole different ball game. Instead of looking for telemarketers, who can follow instructions, and do exactly as they are told, for an hourly wage, companies are looking for someone, who is self-discipline, self-motivated and self-assured in their telemarketing abilities. The summary of these traits, leads you to individuals who would rather purchase purchase a franchise, rather than work a "job," if they had the money. This particular type of individual, usually needs, a support system, with very few restrictionss, and a compensation plan, which allows them to have complete control over their income. This persons, can be almost any one, yet often times are those individuals who already have a monthly income. The downside of a business relationship with this type of individual is, they may earn $6000 for 3 or 4 months, and than decide to travel around the world for a couple months. Of course they return, to earn more commissions, just so they can disappear again. (This is why we are always hiring) We have found, even people on the verge of loosing their home, due to unemployment, are so consumed with looking for a job, that they often times, lack the self-discipline, to "make" a job, even when all the components are provided to them. For this reason, we have found that seniors, or persons who are looking for supplemental income, work best when it comes to business development for Invoice Lines of Credit.
